Elche court sets precedent against holiday let fraud
A court ruling enables action against tenants who sign temporary contracts and refuse to vacate the property.
Court of First Instance number 2 in Elche has issued a pioneering ruling in Spain that opens a new legal avenue against fraud in holiday lettings. The judgement addresses cases where a person signs a temporary or holiday rental contract and subsequently refuses to vacate the property.
This judicial decision marks an important precedent in the fight against fraudulent occupation through short-term contracts. Until now, landlords faced difficulties in recovering their properties when tenants used holiday contracts as a strategy to remain illegally.
