Can a community of neighbours prohibit dogs and cats? The Horizontal Property Law clarifies

Spanish regulations on horizontal property establish clear limits on the prohibition of pets in communities of neighbours.

Living together in communities of neighbours can generate conflicts related to keeping companion animals. Many owners and tenants wonder whether residents’ associations can prohibit dogs and cats in their buildings.

The Horizontal Property Law establishes that pets cannot be prohibited in a blanket manner in a community. The statutes can regulate their use, but cannot completely veto their presence if they do not cause disturbance to neighbours.

However, the regulations allow sanctions if the animals generate problems of hygiene, excessive noise or other inconveniences that affect coexistence. In these cases, the community can demand corrective measures or, in extreme situations, initiate legal proceedings.

Foreign residents who are owners or tenants on the Costa Blanca must be aware of these rights and obligations regarding their pets. The key lies in mutual respect and compliance with basic rules of coexistence.
