Alicante notary María Cristina Clemente Buendía, known on social media as @notariabuendia, has warned about cases where Hacienda can claim additional payments of property transfer tax (ITP) after acquiring a home or property with a mortgage loan.
According to the professional, the tax authority can issue supplementary assessments when it detects discrepancies between the declared value of the transaction and other indicators, such as the valuation carried out by the bank to grant the mortgage.
This situation particularly affects second-hand property buyers who use bank financing, as mortgage valuations usually reflect market values higher than the deed price, which can trigger a tax review.
The notary recommends that taxpayers be aware of these possible checks to avoid financial surprises after purchasing properties in the Comunidad Valenciana.
